Federal and New York State law both allow a person with disability--as defined by the Social Security Administration--to protect financial resources for the purpose of maintaining eligibility for government benefits by using a pooled supplemental needs trust (SNT).

While receiving benefits, a pooled SNT can help a person with a disability purchase life-enhancing items and services that their benefits do not provide. Enrolling in a pooled supplemental needs trust can make considerable improvements to a person's quality of life and, for many of our beneficiaries, gives them the ability to remain in their home and in the community they love.

Pooled Trust Administration

As Trustee, NYSARC will administer the account and distribute funds for the sole benefit of the beneficiary to purchase eligible items and services when provided with required documentation. Trust funds can pay for many things, but not all requests can be paid in order to comply with the policies set by the Social Security Administration (SSA).

Pooled Trust Guidelines as defined by the SSA's program operations manual system (POMS):

  • The pooled trust is established and maintained by a nonprofit association;
  • Separate accounts are maintained for each beneficiary, but assets are pooled for investing and management purposes;
  • Accounts are established solely for the benefit of the disabled individuals;
  • The account in the trust is established through the actions of the individual, a parent, grandparent, legal guardian, or a court; and
  • The trust provides that to the extent any amounts remaining in the beneficiary’s account upon the death of the beneficiary are not retained by the trust, the trust will pay to the State(s) the amount remaining up to an amount equal to the total amount of medical assistance paid on behalf of the beneficiary under State Medicaid plan(s).
